====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 20-03-2020 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek bail in connection with Sabour P.S. Case No. 353 of 2019 registered for the offence punishable under Section 30(A) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that there is no recovery from the conscious possession of the petitioners rather 186.6 liters of country made liquor has been recovered from the Tempo. Learned counsel for the petitioners further submits that the petitioner is in jail custody since 03.12.2019. In the facts and circumstances of the case, I am inclined to grant regular bail to the petitioners. The petitioners

No.2138 of 2020(3) dt.20-03-2020 2/2 are agreed to deposit Rs.10,000/- (ten thousand) in the Juvenile Justice Fund of the State Social Welfare Department and on deposit of the aforesaid amount, the court below shall release the petitioners on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II cum Special Judge (Excise Act), Bhagalpur in connection with Sabour P.S. Case No.353 of 2019.
