The petitioner seeks bail in Udwant Nagar P.S. Case No. 33 of 2019 (NDPS Case No. 2 of 2019), registered for the offence punishable under Sections 20/22 of the NDPS Act. As per the prosecution case, on secret information raid was conducted and 41 Kg. of Ganja was recovered from the house and orchard of the petitioner.

It is submitted on behalf of the petitioner that mandatory provision with regard to search and seizure has not been complied with. Report of FSL is still awaiting. Petitioner is in custody since 15.05.2019.

Learned APP however, vehemently opposed the

Patna High Court CR. MISC. No.1958 of 2020(5) dt.08-01-2021 2/2 prayer for bail and submitted that huge quantity of Ganja was recovered from the house and orchard of the petitioner. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
