Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-06-2020 Heard Mr. Dr. Amrendra Kumar, learned counsel for the petitioners and the learned APP for the State.
The petitioners seek bail in anticipation of their arrest in connection with Phulwariya P.S. Case No. 223 of 2019 dated 04.11.2019 instituted for the offences under Sections 341, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code.
The petitioners are alleged to have surrounded the house of the informant and assaulted
Patna High Court CR. MISC. No.86944 of 2019(3) dt.23-06-2020 2/2 him by means of Lathi.
It has been submitted that there is a counter version of the occurrence and the counter case was lodged prior to the subject FIR. The petitioners are agnates of the informant. The injuries suffered by the informant have been opined to be simple in nature. The cause of occurrence is stated to be old enmity and property dispute.
Considering the aforenoted facts, the petitioner are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Phulwariya P.S. Case No. 223 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
