JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with G.O. Case No. 1167 of 2019, corresponding to Sadar (Bhalpatti O.P.) P.S. Case No. 488 of 2019, registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

As per prosecution case, police on information of selling of liquor by the petitioner reached there and seeing the police party he succeeded in fleeing away and there was recovery of liquor from there.

Submission of learned counsel for the petitioner is that he has falsely been implicated, having no criminal antecedent.

Heard learned APP, who has opposed the prayer for

Patna High Court CR. MISC. No.206 of 2020(2) dt.24-01-2020 2/2 anticipatory bail on the ground that there was recovery of liquor from the petitioner, who is named in the FIR. In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if he surrenders and prays for regular bail, the same shall be considered on the basis of the materials available on the record and, if possible, to be disposed of on the same day.

This application is, accordingly, dismissed.
