Petitioner is apprehending arrest in connection with Complaint Case No. 160© of 2015 for the offence under section 406 and 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

Allegation against this petitioner is that the father of the complainant executed sale deed of the pick up van in favour of the petitioner as the petitioner assured the complainant for purchase of the aforesaid vehicle and depositing the instalment regularly but the petitioner refused to do so despite taking vehicle

Patna High Court CR. MISC. No.7926 of 2020(2) dt.02-03-2020 2/2 Learned counsel for the petitioner submits that petitioner is driver of the pick up van. He has not purchased the pick up van from the father of the complainant. Considering the aforesaid, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Complaint Case No. 160-C/2015 subject to the condition as laid down under section 438(2) of the Cr.P.C.
