The petitioner seeks bail in connection with Punpun P.S. Case No. 198 of 2019, registered under Sections 363, 365 and 366 of the Indian Penal Code.

The accusation is that niece (Bhagini) of informant Subhash Paswan, aged about 14 years moved from her maternal house, but she did not return. Thereafter, intensive search was made by the informant, but no trace was found. The informant raised suspicion against six persons named in the F.I.R. including the petitioner having hand in the kidnapping of his niece.

Learned counsel for the petitioner submits that, in fact, due to love affairs victim, niece of informant, left her

The statement of the victim under Section 164 Cr.P.C. was recorded on 13.08.2019 in which she has stated about moving with the petitioner at Rajasthan according to her sweet will and has not made complaint about her kidnapping by the petitioner. The petitioner, who is aged about 20 years, is in custody since 01.08.2019. Further submission is that after investigation, the Police has submitted Chargesheet. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV, Patna in connection with Punpun P.S.
