JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-06-2020 Heard Mr. Kamlesh Kumar Pathak, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Dholbajja (Kedwa @ Kadwa) P.S. Case No. 69 of 2019, dated 31.08.2019, instituted for the offences under Sections 147, 148, 149, 341, 323, 325, 307 and 504 of the Indian Penal Code.

It appears that several persons have been named in the F.I.R. as having assaulted the prosecution party. The petitioner is said to have assaulted one Binod Singh on his head, but the corresponding injury is opined to be simple in

Under similar circumstances, one of the co-accused persons has been granted anticipatory bail by a Bench of this Court.

Considering the facts afore-stated and taking into account that the petitioner is a person of clean antecedent, he, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Naugachia, Bhagalpur in connection with Dholbajja (Kedwa @ Kadwa) P.S. Case No. 69 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
