Petitioner seeks bail in a case registered for the offence punishable under Sections 25(1-b)a, 26 of Arms Act and Section 30(A) of Excise Act.

Informant has alleged in his self-statement that on receiving specific information, he raided the house of petitioner and from his house, 52.200 litres of foreign liquor as well as from the godrej Almiraha, two country made pistol with twenty live cartridges were recovered.

It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent and he is in custody since 18.10.2019.

Patna High Court CR. MISC. No.650 of 2020(2) dt.20-01-2020 2/2 Considering the facts and circumstances of the case and recovery of foreign liquor as well as arms and ammunition from possession of petitioner, I am not inclined to grant bail to petitioner at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.

However, the petitioner may renew his prayer for bail after one year in jail custody.
