Mr.Rajesh Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 Petitioner seeks regular bail in connection with Dumra P. S. Case No.165 of 2019 registered for the offences punishable under Section 379 of IPC.

As per F.I.R., there is allegation of theft of a motorcycle from the Bar Association of Sitamarhi. Submission of the learned counsel for the petitioner is that he is named in the F.I.R. as such confessional statement, no recovery has been made from his possession and is in custody since 17.08.2019.

Heard learned A.P.P. who opposed the prayer for bail on the ground that he has a criminal antecedent and one witness has also stated that he had heard these persons planning to commit theft of a Motorcycle.

Having heard both sides, in view of the submissions,

No.87016 of 2019(2) dt.14-01-2020 2/2 made above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Dumra P. S. Case No.165 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition to co-operate in disposal of the trial.
