Heard learned counsel for the petitioner, learned counsel for the BSFC and learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in connection with Parasi P. S. Case No. 45 of 2019 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
As per the prosecution case, the co-accused person

No.87228 of 2019(15) dt.16-02-2023 2/3 happens to be Chairman of the Parasi PACS and the petitioner was the Manager of the said PACS and there is allegation of defalcation /misappropriation of Rs. 8,20,000/-. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. Learned counsel further submitted that the defalcation/misappropriation amount has already been paid by the co-accused person namely Jairam Sharma @ Jayram Sharma. Learned counsel also submitted the co-accused person has already been granted bail by the co-ordinate Bench of this Court vide order dated 20.01.2020 passed in Cr. Misc. No. 78236 of 2019. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.
Learned A.P.P. for the State has fairly submitted that the defalcation amount has already been paid by the co-accused persons.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned, Arwal in connection with Parasi P.
Patna High Court CR. MISC. No.87228 of 2019(15) dt.16-02-2023 3/3 S. Case No. 45 of 2019, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure. The application stands allowed.
