The petitioner seeks regular bail in connection with Forbesganj P.S. Case No. 560 of 2019 for the offence punishable under Section 379 of the Indian Penal Code.

The allegation is regarding the motorcycle of the informant being stolen by unknown miscreants. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is further submitted that neither the T.I. Parade has been held so as to implicate the petitioner in the alleged crime nor the stolen motorcycle was recovered from the petitioner and the fact is that he was arrested in one other case, namely, Forbesganj P.S.

Patna High Court CR. MISC. No.86756 of 2019(2) dt.16-01-2020 2/2 Case No. 681 of 2019 and thereafter he has been remanded in the present case as well as in the other case. It is further submitted that the petitioner is languishing in custody since 17.09.2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that no T.I. Parade has been held so as to connect the petitioner with the alleged crime and in fact no stolen motorcycle has been recovered from the petitioner, I deem it fit and proper to direct for release of the petitioners on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S.
