JUSTICE MADHURESH PRASAD ORAL ORDER 17-01-2020 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under section 379 of the IPC.

F.I.R has been lodged by the informant in respect of motorcycle being missing. The same does not name any accused person.

It is submitted by counsel for the petitioner that upon his release in connection with Forbesganj P.S. Case no. 681/2019, he has been remanded in this and three other cases, as per details contained in para 3 of the petition. Implication is merely on suspicion and his own confessional statement recorded before police. There is no

Considering the aforesaid submissions, prayer for bail is allowed.

Let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Forbesganj P.S. Case no. 564/2019 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
