JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-02-2020 The petitioner seeks regular bail in connection with Palasi P.S. Case No. 121 of 2018, registered for offences punishable under Sections 302 and 201 of the Indian Penal Code.

Prosecution case is that the dead body of the daughter of informant was found in a pond and the informant suspects that petitioner and other accused persons have killed her, as earlier there was dispute between the parties. It has been submitted on behalf of the petitioner that except suspicion due to the earlier dispute, there is nothing against him. He is in custody for more than 3 months. Chargesheet has already been submitted, as such, there is no chance of tampering with the evidence.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Araria, in connection with Palasi P.S. Case No. 121 of 2018, subject to the condition that petitioner will cooperate in the investigation and will not make any threat to the informant and his family members.
