JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-02-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Forbesganj ( Simraha) P.S. Case No. 900 of 2018 registered for the offences punishable under Sections 341, 323, 354(B), 379, 427, 504, 506/34 of the Indian Penal Code.

Admittedly, after investigation, police submitted charge sheet for the offences punishable under sections 341, 323, 354(B), 379, 427, 504, 506/34 of the Indian Penal Code against the petitioners and except section 354 of the Indian Penal Code almost all the sections are bailable in nature and so far as section 354 of the Cr.P.C is concerned, the same is not

Patna High Court CR. MISC. No.598 of 2020(2) dt.20-02-2020 2/2 specific rather general allegation of removing the cloths of the informant and others was levelled against the petitioners. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate-II class, Araria in Forbesganj( Simraha) P.S. Case No. 900 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
