JUSTICE MOHIT KUMAR SHAH ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 31-01-2020 Heard learned counsel for the petitioners and learned counsel for the respondents.
Petitioners have prayed for the following relief: "For issuance of writ in the nature of
Patna High Court CWJC No.1793 of 2020(3) dt.31-01-2020 2/3 mandamus for implement to guideline Tender Open System to establishment of 78 Solar Street Light at Mahgama Panchayat under Dharhara, Block, District- Munger as Solar Photomoltaik Program for management of light at Park, Playground, Kabristan and Shamshan, School, road, Chowk. But respondents have not filled up Tender Circular for allotment of work as M/s B.G. Channel, without public notification tender for established to 78 solar street light in different places under scheme of 14th finance scheme.
In these circumstances, respondents have kept to mis-management for misuse/loot to public money without Open Tender in Newspaper. Work has allotted illegally in favour of M/s B.G. Channel Bariyarpur without knowledge of public. Public has objection to illegally allotted work to M/s B.G. Channel Bariyar for established to 78 solar street light without put up place list. But respondent has not taken up positive action against illegally allotted work without place list for established to 78 solar street light.
And further for issuance of writ or writs, direction or directions as the Court may deem fit and proper to the facts and circumstances of this case."
After the matter was heard for some time, learned counsel for the petitioners submits that petitioners shall be
Patna High Court CWJC No.1793 of 2020(3) dt.31-01-2020 3/3 content if a direction is issued to the concerned respondents to consider and decide petitioners' request, not only the one which the petitioners have already made, but also the one which the petitioners would be making afresh within a period of four weeks from today.
Learned counsel for the respondents states that as and when any such fresh request is received, the same shall be considered and decided in accordance with law, with reasonable dispatch, and positively within a period of four months thereof. We clarify that all issues are left open, and only hope and expect that the decision shall be taken at the earliest. The petition stands disposed of in the aforesaid terms.
