The petitioner seeks bail in connection with Raniganj P.S. Case No.254 of 2019 registered under Sections 341, 323 and 302/34 of the Indian Penal Code.

The accusation is that Santosh Rishi (petitioner), the son-in-law of the informant Ramji Risideo, had come before 5 days from Punjab, where he used to do the job for livelihood, but the petitioner and his wife, the daughter of the informant, who had pregnancy of 7 months, used to quarrel. On 30.07.2019, the informant sent his son-in-law (petitioner) and daughter for uprooting the Bichra in the field, where they committed "Maar-Peet" with each other but the daughter of the

Due to suffering from pain of his daughter, the informant took his daughter to Raniganj for treatment from where she was referred to Araria. Thereafter, the son-in-law of the informant (petitioner) fled away from the house. While the informant tried to take his daughter to Purnea for her treatment but, in the meantime, she died.

Learned counsel appearing on behalf of the petitioner submits that, in fact, there was some dispute in between the petitioner and his wife, the daughter of the informant, but in spite of that the petitioner had gone directly at the house of the informant after coming from Punjab. After two days, the petitioner went to his house but, in the meantime, the daughter of the informant, after suffering from pain, died. With an ulterior motive, the informant has falsely implicated the petitioner in the present case. In the post-mortem examination of the daughter of the informant, no external or internal injury was found on her person. The petitioner having no criminal antecedent is in custody since 03.08.2019. After investigation, the police has already submitted the charge-sheet against the petitioner.
