The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 3 R.P.(U.P.) Act.
The prosecution case is that one Rajiv Kumar was arrested with fish plate belonging to the railways, who disclosed the name of the petitioner, being a scrap dealer to whom, he used to sell the fish plate, consequently, on raid being laid in his shop, 25 fish plates were recovered from the shop of the petitioner.
It is submitted by learned counsel for the petitioner that the recovery has not been made from the possession of the petitioner and a statement has been made in paragraph 3 of the
Patna High Court CR. MISC. No.1630 of 2020(2) dt.25-02-2020 2/2 petition that the petitioner is not having any criminal antecedent. Learned APP submits that the recovery has been made from the shop of the petitioner.
Considering the nature of accusation, let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned Court below within a period of six weeks from today in connection with Dehri RPF Case No. 25 of 2019, pending in the Court of learned Additional Chief Judicial Magistrate, Railway, Gaya.
