Petitioner seeks bail in a case registered for the offences punishable under Sections 376(D) of the Indian Penal Code and Sections 4,6,17 of the Prevention of Children from Sexual Offences Act.
In her statement under Section 164 Cr. P.C., the victim is specific that the petitioner was not the rapist rather the petitioner is cousin brother of the informant and the petitioner was wrongly implicated by the police. The informant-victim had not named the petitioner in the first informant report. Considering the fact that there is no substantial material against the petitioner nor there is material to substantiate that the petitioner is going to tamper with the

No.86614 of 2019(2) dt.14-01-2020 2/2 evidence or abscond the process of law, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bettiah Mahila Police Station Case No.14 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below as well as petitioner shall not leave the country without permission of the Court and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
