Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) and 56(b)of the Bihar Prohibition and Excise (Amendment) Act, 2016. 100 liters of liquor was recovered from the Auto Rikshaw of which the petitioner is owner. Petitioner has got identical criminal antecedent. Petitioner was not there at the time of recovery of liquor.
Considering the nature of allegation and criminal antecedent of the petitioner, in my view, the petitioner should be released on bail only after framing of the charges on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with
Patna High Court CR. MISC. No.86611 of 2019(2) dt.14-01-2020 2/2 two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Excise Case No.145 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below as well as petitioner shall not leave the country without permission of the Court and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
