Heard learned counsel for the petitioner. Mr. Vijay Anand, learned counsel for the E.O.U. is appearing. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420,467,468,471,409,120(B) of the Indian Penal Code and Sections 81(1)(C) /81(2) and 81(4) of the Bihar Value Added Tax Act, 2005.

About 80 persons are accused in this case. The main allegation is of evasion of sale tax on the false entries made in the sale invoice generated by three named Companies situated in the State of Jharkhand.

Patna High Court CR. MISC. No.2398 of 2020(3) dt.18-06-2020 2/2 Submission is that some other co-accused have already been allowed anticipatory bail by different Coordinate Benches of this Court as well as one of the co-accused Smt.Sushila Devi has been allowed anticipatory bail by this Court vide orders at Annexure-3 series.

Finding substance in the submission aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Economic Offence P.S.Case No.001 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case and also the petitioner shall not leave the country without permission of the learned Trial Court , failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
