JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Hilsa P.S. Case No. 253 of 2019 registered for the offences punishable under Sections 341, 323, 324, 447, 504, 506, 307/34 of the Indian Penal Code.

Petitioner is said to have given one dagger blow causing injury on the head of the informant's husband but Annexure-2 to the petition goes to show that informant's husband sustained simple injury said to be caused by hard and blunt substance.

In the aforesaid background, learned counsel appearing for the petitioner submits that no case under section 307 of the Indian Penal Code is made out and, moreover, there

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-1, Hilsa, Nalanda in Hilsa P.S.Case No. 253 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
