Mr.Dr. Indiwar Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-01-2020 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Kotwali P.S. Case No. 394 of 2018 for the offence punishable under Section 392 of the Indian Penal Code.

The allegation is regarding unknown miscreants having snatched a bag as well as also taken some cash money from possession of the informant apart from snatching some articles.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, he has not been named in the F.I.R. and no recovery of the looted articles has been made from the

Patna High Court CR. MISC. No.87347 of 2019(2) dt.16-01-2020 2/2 petitioner, nor T.I.P. has been held to connect the petitioner with the alleged crime. The petitioner is stated to be languishing in custody since 02.07.2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that neither any T.I. Parade has been held to connect the petitioner with the alleged crime nor any recovery of stolen articles have been made from possession of the petitioner, I deem it fit and proper to direct for release of the petitioners on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- XIV, Bhagalpur in connection with Kotwali P.S. Case No. 394 of 2018.
