JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Saharghat P.S. Case No. 99 of 2019 registered for the offences punishable under Sections 341, 323, 354(B), 379, 504, 506/34 of the Indian Penal Code.
Except Sections 354(B) and 379 of the Indian Penal Code, almost all the sections are bailable in nature. The accusation against the petitioner is that he outraged the modesty of the informant but submission on behalf of the petitioner is that it was prosecution party who assaulted the petitioner as well as his other family members for which wife of the petitioner lodged Saharghat P.S. Case No. 100 of 2019 against the
Patna High Court CR. MISC. No.492 of 2020(2) dt.24-02-2020 2/2 informant as well as her other family members. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Benipatti in Saharghat P.S. Case No. 99 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
