Mr.Md. Mushtaque Alam ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-01-2020 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Andhratharhi P.S. Case No. 96 of 2019, G.R. No. 2305 of 2019 for the offence registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 96 litres of illicit Nepali country made liquor from a vehicle and the petitioner is stated to have fled away after seeing the Police. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is languishing in

Patna High Court CR. MISC. No.86216 of 2019(2) dt.14-01-2020 2/2 custody since 02.12.2019. Lastly, it is submitted that neither the illicit liquor nor the vehicle belongs to the petitioner and the petitioner has been falsely roped in the present case. Having regard to the facts and circumstances of the case and considering the submissions of the learned counsel for the petitioner, I deem it fit and proper to direct for release of the petitioner herein on regular bail.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Session Judgecum-Special Judge, Excise Act, Madhubani in connection with Andhratharhi P.S. Case No. 96 of 2019, G.R. No. 2305 of 2019.
