Petitioner apprehends arrest in connection with Gopalpur P.S. Case No. 87 of 2019 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. There is case and counter case. There is a land dispute between the parties. Petitioner has no criminal antecedent. Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is named accused in the first information report. Morevoer, the

Patna High Court CR. MISC. No.87082 of 2019(5) dt.16-11-2021 2/2 allegations levelled against the petitioner has been supported by the injuries sustained. Petitioner, therefore, does not deserve to be granted the privilege of bail. Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
