ANJANA MISHRA ORAL ORDER 20-01-2020 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 14.11.2019 in connection with Fatuha P.S. Case No.795 of 2019 registered for the offence under Sections 147, 149, 341, 323, 302, 504 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the only reason why the present petitioner has also been implicated in this case because he has filed an F.I.R. alleging fuel theft from his own truck. It is also submitted that because other co-villagers had attacked the alleged thief, who was severely beaten up, which has resulted in his death and the petitioner was also one of the persons who had complained and was aggrieved by the theft of the fuel, his name has also been included, though

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Patna City, Patna, in connection with Fatuha P.S.
