JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-03-2020 Affidavit is filed for removal of defect, as pointed out by the office. Let supplementary affidavit be kept on record. Although, this matter has been listed under the heading for "For Orders (On Office Notes)" but defect, as pointed out by the office, has already been removed and with the consent of both the parties, this petition is being disposed of. Heard learned counsel appearing for the petitioner as well as learned A.P.P. for the State.

Petitioner is in jail custody since 7.9.2019 in connection with Sitamarhi P.S. Case No. 503/2019 registered under Section 414 of the Indian Penal Code and 25(1-b)a, 26(ii) and 35 of the Arms Act.

It would appear from perusal of the first information report that loaded Katta and several other articles were

Learned counsel appearing for petitioner submits that nothing has been recovered from the conscious possession of the petitioner and, moreover, the petitioner is in custody since 7.9.2019 and the investigation against him has already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IV, Sitamarhi in connection with Sitamarhi P.S. Case No. 503/2019.
