2. Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 126(2), 127(2), 115(2), 308(2), 109, 303(2), 352, 351(2), 3(5) of B.N.S., 2023.

3. Prosecution story in brief is that when the informant was going to his house in the evening then both the petitioners surrounded the informant and abused him as both parties are the the business competitors (contractors) and both petitioners demanded Rangdari of Rs. 10 lakh to the informant.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. He further submits that there is no specific allegation against the petitioners of assault and the petitioners have no criminal antecedent, as statement made in para 3 of the bail

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and the fact that the informant as well as petitioner No.1 are contractors and there appears to be a business rivalry between the two which may have resulted in lodging of the F.I.R. against the petitioners and there is also a case and counter case between the parties, which has been disclosed in paragraph No.12 of the application, I am inclined to grant privilege of anticipatory bail to the petitioners.

Let the petitioners, as named above, in the event of their arrest or surrender within four weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in connection with Mirganj P.S. Case No. 552 of 2025, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
