This is an application for grant of anticipatory bail in
Patna High Court CR. MISC. No.2301 of 2020(2) dt.16-01-2020 2/3 connection with Khagaria P.S. Case No. 163 of 2017, registered for the offence punishable under Sections 147, 148, 149, 342, 323,337, 353, 225, 506 and 511 of the Indian Penal Code. The allegation is regarding named accused persons as also about 150-200 unknown persons having formed a mob and illegally blocked the main road and when the police force had come there, the mob had created a commotion and had demanded arrest of some persons, who were involved in assaulting some other persons. It is further alleged that the said mob had then thrown bricks on the police force, as also had tried to snatch the accused persons from the custody of the police.
The learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in the present case, they are having a clean antecedent and there is no allegation of any sort of overt act. Nonetheless, it is submitted that the petitioners are ready to deposit a sum of Rs. 5000/- each for the purposes of securing the privilege of anticipatory bail. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioners, I deem it fit and proper to direct the petitioners to deposit a sum of Rs. 5,000/- each before the nazarat of the
Patna High Court CR. MISC. No.2301 of 2020(2) dt.16-01-2020 3/3 learned civil court at Khagaria whereupon the petitioners herein would be entitled to the privilege of anticipatory bail, subject to such conditions as may be deemed fit and proper to be imposed by the learned court of J.M. 1st Class, Khagaria in connection with Khagaria P.S.Case No. 163 of 2017.
With the aforesaid observations and directions, the present petition stands disposed of.
