JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-06-2020 Heard Mr. Sanjay Kumar Jha, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Bounsi P.S. Case No. 153 of 2010 dated 10.09.2010 instituted for the offences under Sections 147, 148, 341, 323, 384, 379, 504 and 506 of the Indian Penal Code.

It appears that ten persons have been named in the First Information Report and the petitioner is said to have exhorted those persons for stopping the work of

It has been submitted on behalf of the petitioner that an absolutely false and concocted case has been lodged against him. There is no specific accusation of assault. There was dispute with respect to the transaction of money for sell/purchase of land between the company and the petitioner and only in order to forbid the petitioner for making any further demand with respect to sell/purchase of land, this case has been lodged. It has further been submitted that considering these aspects of ht matter, all other accused persons have been granted bail by the Court below. Regard being had to the aforesaid submissions this court directs that in case the petitioner surrenders before the court below and seeks bail, the court below shall consider all the afore-noted aspects and submissions raised on behalf of the petitioner and shall pass order in accordance with law without being prejudiced by the fact that the present petition on behalf

Patna High Court CR. MISC. No.87230 of 2019(3) dt.25-06-2020 3/3 of the petitioner has not been entertained.
