The petitioner is in custody in connection with Special Case No. 101 of 2019 arising out of Rail P.S. Bhaktiyarpur Case No. 125 of 2019 for the offenses under Sections 8, 20(b) (ii) of the N.D.P.S. Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 6.5 kgs of Ganja was seized from the railway platform. The petitioner, along with other persons, has been arrested merely on suspicion, on 23.08.2019 and the police, after investigation, has charge sheeted on 16.11.2019.

Considering the fact that the petitioner is 65 years

Patna High Court CR. MISC. No.5201 of 2020(2) dt.31-01-2020 2/2 aged and he has no criminal antecedent, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XVII cum Special Judge (N.D.P.S. Act), Patna, in connection with Special Case No. 101 of 2019 arising out of Railway P.S. Bhaktiyarpur Case No. 125 of 2019.
