Heard the parties.
The petitioner is languishing in custody for the offences punishable under Sections 25(1-AA)/25(1-B)a/26/35 of the Arms Act and Sections 10/13/19/20 of the Unlawful Activities (Prevention) Act.
The petitioner is in custody since 03.06.2016. Submission is that recovery of arms and ammunition was from a different village of co-accused Hira Lal Singh and Ran Vijay Singh and not from the conscious possession of the petitioner or from the house of the petitioner. Hira Lal Singh and Ran Vijay Singh have already
Patna High Court CR. MISC. No.5659 of 2020(3) dt.29-05-2020 2/3 been allowed bail by different coordinate Benches of this Court. Considering the criminal antecedent of the petitioner earlier prayer for bail was refused by a Bench of this Court vide order at Annexure-1.
Considering the period already undergone by the petitioner and no chance of conclusion of trial in near future due to ongoing lock down, let the petitioner, above named, be released on bail, on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Nawanagar P.S. Case No. 107 of 2013 with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
If the petitioner would not be able in furnishing sureties due to lock-down, he shall be provisionally released on his personal bond and the provisional bail shall be
