Heard Mr. Jeetendra Narayan, learned counsel for the petitioner and Mr. Sunil Kumar Pandey, learned Additional Public Prosecutor for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 188, 272, 273/34 of the Indian Penal Code, Sections 30, 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
The recovery of liquor is alleged from the field side. The petitioner was not there at the time of recovery. Petitioner is in custody since 24.09.2019. Investigation of the case is already complete against the petitioner.
Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of
Patna High Court CR. MISC. No.86325 of 2019(4) dt.12-05-2020 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Taraiya P.S. Case No. 267 of 2018, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
If the petitioner would not be comfortable in furnishing bail bond due to lock-down, he shall be provisionally released on his personal bond and the provisional bail shall be confirmed only after production of the bailors within fifteen days of restoration of normal function of the Court.
