2. The petitioner seeks bail, who is in custody since 04.11.2025 in connection with Patori P.S.Case No.362 of 2023, F.I.R. dated 01.06.2023 registered for the offence punishable under Sections 341,323,307,354,379,427,504 and 34 of IPC.
3. Allegation against the petitioner is that he assaulted to the informant's mother-in-law with iron rod causing injury on her head.
4. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. It appears from the FIR itself that due to admitted land dispute the present occurrence had taken place and both the parties are agnates to
Patna High Court CR. MISC. No.1039 of 2026(5) dt.18-04-2026 2/3 each other and one T.S. No. 35 of 2016 is pending before the competent court of law between the parties. As per allegation in the FIR, the petitioner has assaulted to the informant's motherin-law, namely, Janki Devi and she has received the injury. Learned counsel for the petitioner submits that there was no intention to kill anyone and due to spur of moment the present occurrence had taken place, although she has received the injury. The co-accused persons, namely, Priyanka Devi and others have been granted privilege of anticipatory bail by a Coordinate Bench of this Hon'ble Court vide order dated 20.08.2024 passed in Cr. Misc. No.48064 of 2024 and coaccused persons, namely, Pankaj Kumar and others have also been granted privilege of anticipatory bail by the same Coordinate Bench of this Hon'ble Court vide order dated 07.02.2025 passed in Cr. Misc. No.7806 of 2025 respectively and the police, after investigation, submitted chargesheet against the petitioner and the petitioner is in custody since 04.11.2025.
5. Learned A.P.P. for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner.
6. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount
Patna High Court CR. MISC. No.1039 of 2026(5) dt.18-04-2026 3/3 each to the satisfaction of learned J.M.-1st Class, Samastipur in connection with Patori P.S.Case No.362 of 2023, with the following conditions:- (I) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the Court below. (II) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
(III) And, further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
