The petitioners are apprehending their arrest in connection with Madhepura (Parmanandpur O.P.) P.S.Case No627 of 2019 dated 21.7.2019 registered for offences punishable under Sections 341, 323, 307, 379, 447, 504, 506 and 34 of the Indian Penal Code.

Petitioner no.1 is said to have assaulted by rod to the informant and the allegation against the petitioner no.2 is of snatching away the golden chain Submission of the learned counsel for the petitioners is that there is case and counter case between the parties and there is no serious injury.

Patna High Court CR. MISC. No.2946 of 2020(2) dt.24-01-2020 2/2 Heard learned A.P.P. , who has opposed the prayer for bail on the ground that the injury report discloses that there was fracture on the head, which appears from the typed copy of the Annexure-3..

Having heard both sides and in view of submissions as made above, so far petitioner no.1 (Bihari Tanti) is concerned, I am not inclined to grant privilege of anticipatory bail to the petitioners, however, the petitioner are directed to surrender before the learned court below and make prayer for regular bail. So far petitioner no2 (Gardeep Tanti) is concerned, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Madhepura in connection with Madhepura (Parmanandpur O.P.) P.S.Case no.627 of 2019 dated 21.7.2019, subject to conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is disposed of.
