The petitioner seeks regular bail in connection with Bikramganj P.S. Case No. 332 of 2019 for the offence punishable under Sections 384, 34 of the Indian Penal Code and Section 7 of the Prevention of Corruption Act. The allegation is regarding a Whats app clip being circulated wherein a group of police personnel were shown demanding bribe from the truck driver as also were seen accepting bribe from them.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case, is having a clean antecedent and a bare perusal of the video clip itself reveals that as far as the petitioner is concerned,

Patna High Court CR. MISC. No.86746 of 2019(2) dt.16-01-2020 2/2 his face is not visible/ recognizable in the picture, hence it cannot be said that it was the petitioner who was receiving bribe. Lastly, it is submitted that the petitioner is languishing in custody since 12.10.2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that the petitioner has been roped in the present case on suspicion and his identity is not clear from the video clip, I deem it fit and proper to direct for release of the petitioners on regular bail. Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance, Patna in connection with Bikramganj P.S.
