JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-06-2020 Heard Mr. Ashok Kumar Singh, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Obra P. S. Case No. 142 of 2019 dated 04.06.2019 instituted for the offences under Sections 376, 511, 504, 506 and 34 of the Indian Penal Code. The accusation against the petitioner is of having made an attempt to outrage the modesty of the prosecutrix.

Patna High Court CR. MISC. No.87333 of 2019(3) dt.25-06-2020 2/3 It has been submitted on behalf of the petitioner that both him and his father have been made accused in this case. The prosecuritx / informant is the own aunt of the petitioner. The family property, it has been argued, was divided between the father of the petitioner and the husband of the informant long time ago. However, a contentious dispute remained pending which was with respect to the passage. For such dispute, an attempt has been made by the informant to malign the reputation of the petitioner and his father as also for the purpose of putting some pressure on him.

However, looking at the nature of accusation against the petitioner and the relationship between the parties, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Daudnagar, in the district
