JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-07-2026 The present petition has been filed for restoring a petition bearing MJC No. 884 of 2024, which has stood dismissed on account of non-compliance of the peremptory order dated 16.05.2025.

The learned counsel for the petitioner submits that on account of the laxity of the Advocate clerk, the defects, as pointed by the registry, could not be removed within time, hence a sympathetic view be taken and the aforesaid petition be restored to its original file.

Having regard to the facts and circumstances of the case and considering the averments made in the present petition, I

Patna High Court MJC No.9 of 2026(3) dt.24-07-2026 2/2 deem it fit and proper to restore the aforesaid petition bearing MJC No. 884 of 2024 to its original file, however subject to removal of the defects within a period of two weeks from today. 4.

Accordingly, the present petition stands disposed off on the aforesaid terms.
