The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,307,379,452 and 504/34 of the IPC.

The prosecution case as per the written report of Laxman Prasad Gupta submitted to the SHO, Bikramganj Police Station is to the effect that the petitioner and co-accused Balram Lal, brother of the petitioner entered into the shop of the informant and started throwing articles. On protest being made, they assaulted the informant and his son with the iron rod causing injury and they also snatched gold chain.

It is submitted by learned counsel for the petitioner that the injury has been found simple and even assuming accusation

Patna High Court CR. MISC. No.4845 of 2020(3) dt.29-02-2020 2/2 to be true, no case under Section 307 of the IPC is made out against the petitioner. The petitioner is accused in one another case in which he is on bail.

Learned APP submits that the petitioner is named in the FIR.

Considering the nature of accusation and the nature of injury being caused, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Bikramganj, Rohtas in connection with Bikramganj P.S. Case No.282 of 2019 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
