The petitioner seeks bail in Mokama P. S. Case No. 241 of 2019, instituted for the offence under Section(s) 414/34 of the Indian Penal Code and Sections 25(1-B) a /26/35 of the Arms Act.

The First Information Report is lodged by the A.S.I. that during duty of vehicle checking two persons have been apprehended on a Maroon bullet motorcycle. The said apprehended persons have disclosed the name of petitioner and some other persons as associates. It is, under such circumstance, that petitioner has been arrested and is in custody since 23.10.2019. There is no recovery whatsoever to suggest the petitioner's involvement. Patna High Court CR. MISC. No.86262 of 2019(2) dt.17-01-2020 2/2 accused, there is no material on the record to connect the petitioner with the occurrence. In Jhajha P.S. Case No. 16 of 2019, the petitioner is already on bail. The incriminating articles have been recovered from other co-accused persons. The learned APP for the State opposed the prayer for bail. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Barh, Patna, in connection with Mokama P. S. Case No. 241 of 2019, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
