Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016. 35 liters of liquor was recovered from possession of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent. He is in custody since 28.10.2019. Investigation of the case is already complete. Considering the facts aforesaid as well as the fact that there is no material to suggest that the petitioner is going to tamper with the evidence or abscond the process of law, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court CR. MISC. No.200 of 2020(2) dt.16-01-2020 2/2 bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No.9626 of 2019, N.T.P.S. P.S.Case No.86 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below as well as petitioner shall not leave the country without permission of the Court and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
