JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 This is an application for grant of anticipatory bail in connection with Parsa Bazar P. S. Case No. 337 of 2018, disclosing offences under Sections 341, 323, 325, 447, 376, 511 and 504/34 of IPC.

As per F.I.R. there is allegation against the petitioner that he entered inside the house of the informant and attempt to commit rape upon the daughter of the informant. On hulla, he fled away, later on, petitioner came, who was assaulted by the petitioner and other accused persons.

Submission of the learned counsel for the petitioner is that due to land dispute, he has falsely been implicated in this case. The witnesses have supported the prosecution case during the investigation.

Learned A.P.P. drawing my attention towards the

Patna High Court CR. MISC. No.87130 of 2019(2) dt.23-01-2020 2/2 impugned order that the statement of the informant u/s 164 Cr.P.C. the victim girl has supported the prosecution case and informant and other witnesses have also supported the prosecution case.

Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail.
