None ====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 20-04-2024 Learned counsel for the petitioner is present. However, no one appeared on behalf of the State.

2. This writ petition has been filed for directing the respondent authorities to pay the salary of the petitioner because he has not got salary since the year 2017. Moreover, petitioner has been provided suspension letter as well.

3. Counsel for the petitioner submits that petitioner has filed representation through his counsel but no response has been made. Counsel submits that there is no communication made by the authorities of the bank after service of notice.

4. It transpires to this Court that learned counsel for

Patna High Court CWJC No.3907 of 2020(2) dt.20-04-2024 2/2 the petitioner sent legal notice under Section 80 of the Code of Civil Procedure but instead of preferring the suit, he has filed writ petition.

5. Accordingly, this writ application is disposed off granting the liberty to the petitioner that he may sue in furtherance of the legal notice sent to the Bank under Section 80 of Code of Civil Procedure by way of filing the suit. (Dr. Anshuman, J) Sunnykr/- U
