The petitioner seeks regular bail in connection with Daudnagar PS case no. 302 of 2019 instituted for the offence punishable under Sections 395/397 of Indian Penal Code.

The allegation is regarding unknown miscreants having looted cash worth Rs. 20 lacs approximately from the informant.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and his name has transpired in the present case on account of confessional statement having been made by

Patna High Court CR. MISC. No.86762 of 2019(2) dt.17-01-2020 2/2 co-accused namely Guddu @ Rohit. It is further submitted that neither any test identification parade has been conducted in order to connect the petitioner with the alleged crime nor any recovery of the looted cash amount has been made from the petitioner. The petitioner is said to be languishing in custody since 05.11.2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that neither any test identification parade has been held nor any looted cash has been recovered from the possession of the petitioner, I deem it fit and appropriate to release the abovenamed petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Aurangabad in connection with Daudnagar PS case no. 302 of 2019.
