The petitioner seeks regular bail in connection with Muffasil P.S. Case No. 540 of 2019, for the offence punishable under Sections 272, 273, 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 1287 liters of illicit Nepali liquor from a pick-up van.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 18.11.2019. Having regard to the facts and circumstances of the

No.3380 of 2020(2) dt.20-01-2020 2/2 case, considering the submissions advanced by the learned counsel for the petitioner, coupled with the fact that the petitioner is having a clean antecedent, I deem it fit and proper to direct for release of the petitioner on regular bail. Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 9th Additional District & Sessions Judge cum Special Judge Excise Act, East Champaran in connection with Muffasil P.S. Case No. 540 of 2019.
