2. The petitioner seeks bail in connection with Madanpur P.S. Case No. 383 of 2025 registered for the offence under Sections 140(3) of the BNS and under Sections 103(1), 61(2), 238, 3(5) of the BNS have been added later on.

3. As per the prosecution case, unknown criminals are said to have committed murder of the deceased.

4. The petitioner is in custody since 30.09.2025.

5. Learned counsel for the petitioner has submitted that in the confessional statement of one Chotu Kumar, it has come that the petitioner has caught hold of the deceased and he is not the assailant of the deceased.

6. Learned counsel for the informant has opposed

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad/concerned Court below in connection with Madanpur P.S. Case No. 383 of 2025.
