Petitioner apprehends his arrest in a case registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act.

The prosecution case, in brief, is that the recovery of 50 litres of country made liquor and 10 cane of Kingfisher wine have been made from bathroom of the house of the petitioner.

Learned counsel for the petitioner, while refuting the allegation, submits that petitioner has falsely been implicated in this case. It has further been submitted that nothing has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent. In view of the nature of allegation against the
