JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 This is an application for grant of anticipatory bail in connection with Complaint Case No. 06 of 2018 disclosing offence under Section 498A of IPC and Section 4 of D.P. Act. As per complaint case, petitioner happens to be the husband of the complainant and there is allegation of demand of one Maruti Car and also ousted her from the house. Submission of the learned counsel for the petitioner is that the allegation is false and concocted. He is still ready to keep her with dignity and care, that stand has also been taken by the Additional Sessions Judge, but the same has not been considered.
Heard learned A.P.P. as well as learned counsel for the
Patna High Court CR. MISC. No.87135 of 2019(2) dt.23-01-2020 2/2 opposite party no.2, who has submitted that she was brutally assaulted and in such a situation, it is not possible for her to reside with him. Further submission is that in the maintenance case, maintenance was allowed, but the same is not being paid by the petitioner. Two minor daughters are also there. Having heard both sides, considering the above submission, this application is disposed of with a direction to the petitioner, if he undertakes to pay the maintenance amount, as directed by the Family Court, unless the same is modified or set aside by the higher court, petitioner shall be released on bail to the satisfaction of the court below.
