JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2020 Petitioner seeks bail in connection with Galgaliya P.S. Case No. 43 of 2019, registered for the offences punishable under Sections 461, 379 and 34 of the Indian Penal Code. Case relates to theft committed in the State Bank of India and petitioner is not named in the FIR and later on he has been made accused on the basis of recovery of mobile phone, cash and other articles.

Submission of learned counsel for the petitioner is that those articles have not been put on T.I. parade and he is in custody since 2.8.2019 and other co-accused persons have been granted bail by co-ordinate Bench of this Court by order dated 25.10.2019 passed in Cr.Misc.No.62452 of 2019 along with Cr.Misc.No. 62570 of 2019.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Kishanganj, in connection with Galgaliya P.S. Case No. 43 of 2019.
