The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code.

It is alleged that on recovery of a dead body from a water tank, the FIR was lodged against unknown. During investigation, it transpired that the petitioner, being the night guard was seen by the victim while committing theft of diesel and on his complain the petitioner was removed from the service and other witnesses have also supported the same. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the name of the petitioner sprang up during investigation.

Considering the suspicious nature of accusation and statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Samastipur in connection with Patory @ Shahpur Patori (Mohanpur O.P.)
